Political activist Nuru Okanga Maloba is a free man after a Nairobi court acquitted him of all charges related to the alleged publication of false information online.
In a ruling delivered on Tuesday, January 20, 2026, the trial magistrate, Rose Ndombi, determined that the prosecution’s evidence fell significantly short of the legal threshold required to sustain the three charges brought under the Computer Misuse and Cybercrimes Act.
While the court acknowledged the serious nature of the content in question, the case ultimately crumbled due to a lack of direct linkage to the accused.
Magistrate Ndombi noted that investigators failed to prove Okanga was the one who authored, uploaded, or disseminated the video.
Furthermore, the court found no proof that the material was capable of inciting chaos or violence.
Explaining the decision to dismiss the matter before it reached the defense stage, the magistrate stated.
“Upon consideration of all the evidence and applicable law, this court finds that the prosecution has failed to establish a prima facie case against the accused person in respect to all the three counts.”
Following the acquittal, Okanga’s advocate and Embakasi East MP, Babu Owino, took to social media to celebrate the end of the year-long legal battle.
Owino framed the result not just as a courtroom win, but as a preservation of personal liberty.
On his Facebook page, the lawmaker shared, “Today, justice spoke. After a long and exhausting year in court, Nuru Okanga walked free when the Honourable Magistrate ruled that the prosecution failed to present sufficient evidence. This is more than a legal victory, it is the saving of a life, one man rescued from the jaws of prison.”
He further noted, “We celebrate this hard-fought triumph with deep gratitude to the dedicated counsel whose tireless defense, commitment, and belief in justice made this moment possible. Today, hope prevailed.”
