Produce him dead or alive, High Court directs IG Kanja on Mwenda Mbijiwe

NAIROBI: The High Court in Milimani has issued a seven-day ultimatum to Inspector General of Police (IG) Douglas Kanja to file a comprehensive report on the disappearance of security consultant Mwenda Mbijiwe.

Justice Martin Muya termed the ruling a “final adjournment,” directing the IG to present a full account of the investigation into Mbijiwe, who has been missing for four years.

The case is set for mention on December 3, 2025, for further directions.

During the hearing, lawyer Evans Ondieki, representing the family, accused the Office of the IG, the Directorate of Criminal Investigations (DCI), and the Office of the Director of Public Prosecutions (ODPP) of obstructing justice.

He claimed these agencies have been “shifting goalposts” and failing to provide truthful or consistent information to the court.

“Four years since his abduction, the family still does not know whether Mbijiwe is alive or dead,” Ondieki submitted.

He urged the court to consider issuing an arrest warrant against the IG for the failure to provide satisfactory updates.

Ondieki noted that on November 14, 2025, a representative from the DPP claimed an investigation file had been forwarded by the DCI, yet its contents remain undisclosed.

The family argues that this lack of transparency has caused immense emotional anguish, particularly for Mbijiwe’s mother, who frequently travels from Meru to Nairobi for court sessions in hopes of learning her son’s fate.

Their application seeks to compel the State to produce Mbijiwe, dead or alive, to bring closure to the matter.

Justice Muya warned that no further delays would be tolerated and ordered the IG to address all issues raised by the family and the prosecution before the next hearing.
