Migori Court sentences ‘Kibaki’ to 30 years for violent robbery, rape, and assault

A Magistrate Court sitting in Migori has handed down a combined custodial sentence to a local man found guilty on multiple criminal charges, including robbery with violence, rape, and possession of suspected stolen property.

The convict, identified as Collince Okoth Otieno, alias “Kibaki,” from Nyamunga, was sentenced following his trial on multiple counts stemming from criminal incidents occurring in 2024.

According to the official court records, the prosecution successfully argued multiple criminal counts against Otieno.

For the first count of robbery with violence, the court found that on February 23, 2024, at approximately 1:30am in Winyo Village, East Kamagambo Location, Rongo Sub-County, he violently robbed a female victim of Sh1,100 in cash and a mobile phone valued at Sh31,100 while threatening her with physical violence.

On the second count, Otieno was convicted of rape under the Sexual Offences Act for forcing sexual penetration without consent during the same February incident.

The third count involved a charge of assault occasioning actual bodily harm for willfully and unlawfully assaulting a male victim, Joshua Onyango Adika, who was present during the altercation.

Finally, the fourth count detailed that when Otieno was later apprehended on July 28, 2024, at Nyamunga Village, he was found in possession of an array of suspected stolen mobile electronics.

These included an Infinix Hot 10, multiple Tecno, Nokia, and Itel phones with defaced IMEI numbers, alongside several mobile network SIM cards.

During the reading of the judgment, Senior Principal Magistrate Chrispine Oruo took the convict’s mitigation into consideration before delivering the final penalties.

30 years behind bar

Instead of the mandatory life or death sentences historically associated with robbery with violence under Kenyan law, the court sentenced the accused to 30 years of imprisonment for Count I.

For Count II (rape), the accused was sentenced to 10 years of imprisonment, and for Count III (assault), he received a sentence of 5 years of imprisonment.

The court ordered that all sentences will run concurrently, meaning he will serve a maximum of 30 years. Furthermore, because the convict has been held in custody since August 5, 2024, the magistrate directed that the sentence shall officially start running from the date he was first remanded in custody to reflect the time already served.

The convict was granted the standard 14-day window to file a right of appeal against the court’s decision.
