Justice for a Child: The Story Behind a Life Sentence in Webuye

BUNGOMA: A Webuye Court has sentenced a man to life imprisonment after he was found guilty of copious counts pertaining to sexual violence.

Benard Musindi was adjudged guilty on 28th August, 2025, after Webuye Principal Magistrate Hon. Viola Biwott considered the evidence and testimony presented before her.

On the fateful day, 16th September 2024, in Bungoma County, members of the public found a visibly shaken girl, aged 8 years, crying bitterly outside her uncle’s residence.

She was having difficulty walking. A quick inquiry by the members of the public unearthed a disturbing reality: She had been sexually abused by her uncle.

They expeditiously took the minor to the hospital for medical attention and immediately reported the matter.

Officers from the nonpareil DCI Anti-Human Trafficking and Child Protection Unit swung into action, apprehending the vile Benard Musindi, and subsequently charging him with multiple offences at Webuye Law Court.

The charges were: Two counts of incest under Section 20(1) of the Sexual Offences Act No. 3 of 2006; one count of deliberate transmission of a life-threatening sexually transmitted disease, contrary to Section 26(1)(c) of the same Act; and child abuse under Section 22(1)(b) as read with Section 22(2) of the Children Act No. 29 of 2022.

The DCI welcomes this judgement, which is the culmination of a meticulous investigation by our elites, coupled with flawless cooperation among the Criminal Justice System players.

It underscores the Directorate’s commitment to ensuring justice is served to victims of sexual and gender-based violence.
